ПРАВОВІ АСПЕКТИ ПЕРЕБУВАННЯ НА ТЕРИТОРІЇ УКРАЇНИ ПІДРОЗДІЛІВ ЗБРОЙНИХ СИЛ ІНШОЇ ДЕРЖАВИ

Запропоновано результати дослідження проблеми законодавчого врегулювання перебування на території України військових формувань іноземної держави як фактору, що є чинником, який суттєво впливає на стан забезпечення національної безпеки. Розглянуто питання про правові підстави прийняття рішення про надання дозволу на таке перебування, порядок допуску підрозділів збройних сил інших держав на територію України, умови перебування в Україні підрозділів збройних сил інших держав, порядок здійснення контролю за їх діяльністю під час перебування на території України. Проведено аналіз окремих законодавчих норм, що регулюють питання іноземної військової присутності на території України, та сформульовано рекомендації щодо заходів, які необхідно вжити для усунення виявлених недоліків у формуванні та реалізації державної політики у цій сфері. Автори вважають, що присутність російського чорноморського флоту на території України стала одним із чинників, які призвели до анексії Кримського півострова та надала можливість росії здійснити протягом 2014- 2022 років нарощування особового складу та військової техніки збройних сил, а також створити нові військові частини та підрозділи, які згодом були залучені до повномасштабного вторгнення в Україну 24 лютого 2022 року.
